Introduction

Mood Lifters provides mental health support under the U.S. registered trademark “Mood Lifters Our Strategy Your Strength®.”

The Mood Lifters Application (“App”) and website at www.moodlifters.com (“Site”) are tools through which we assist you, the participants who access our Site or App, in managing commonplace mental health challenges such as depression and anxiety.

These Terms of Service and the related Privacy Policy (collectively, “Terms”), which we will update on an annual basis if not more frequently, governs your use of the App, the Site and related services.

By accessing the App or Site, participants agree to abide by these Terms.

What we do/do not do

Mood Lifters is committed to providing cost effective mental health guidance based on currently applicable, scientifically validated methods and processes.

Mood Lifters services are not a substitute for diagnosis or treatment by physicians, psychologists or other licensed caregivers.

We do not promise to relieve specific symptoms or improve the lives of our participants.

Client requirements

Mood Lifters services are generally intended for people who are at least 18 years of age. Where we offer specialized Mood Lifters programs for younger participants, they will be required to confirm consent of parents or guardians.

Upon entry into a Mood Lifters program, participants must agree to specific guidelines governing respect and consideration for one another, as well as strict confidentiality. These guidelines may be revised at any time at Mood Lifters’ discretion.

Participants are expected to refrain from copying or disseminating printed media or other materials provided in any format with Mood Lifters programs.

Participants are expected to keep their Mood Lifters account secure at all times.

Mood Lifters may terminate any participant’s account, along with the related services, at any time in its sole discretion.

Mood Lifters is currently limiting services to participants within the continental United States.

Trademark and Copyright ownership

“Mood Lifters” is a common law service mark of Mood Lifters LLC, and “Mood Lifters Our Strategy Your Strength” is a registered U.S. trademark of Mood Lifters LLC. All design elements and functionality of the App and Site, all content delivered or displayed via the App or Site and all materials otherwise provided to participants by Mood Lifters in any format is proprietary and subject to Mood Lifters’ copyright unless explicitly indicated otherwise. Members may not copy, reproduce, republish, upload, post, display, transmit or otherwise disseminate any of these materials without prior written consent from Mood Lifters LLC.

Disclaimers

ALL INDIVIDUALS WHO USE THE MOOD LIFTERS APP OR SITE, REGARDLESS OF WHETHER THEY FORMALLY ENGAGE WITH MOOD LIFTERS GROUPS, UNDERSTAND AND AGREE THAT THE APP, SITE, SERVICES AND CONTENT IS PROVIDED ON AN “AS IS” BASIS. MOOD LIFTERS DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS (INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE OR NONINFRINGEMENT, OR THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) WITH REGARD TO INFORMATION OR SERVICES PROVIDED VIA THE APP OR SITE. IN ADDITION, MOOD LIFTERS DOES NOT GUARANTEE THAT THE APP OR SITE WILL BE FREE FROM ERROR OR MALFUNCTIONS INCLUDING BUT NOT LIMITED TO DOWNTIME, SERVICE DISRUPTIONS, VIRUSES, MALWARE OR ADWARE.

Liability

THE USE OF THE SITE OR APP IS ENTIRELY AT USERS OWN RISK, AND IN NO EVENT SHALL MOOD LIFTERS BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, MONETARY OR OTHER DAMAGES, FINES OR LIABILITIES ARISING OUT OF MOOD LIFTERS’ TECHNOLOGY, CONTENT, INFORMATION, METHODS AND PRACTICES. USERS’ SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH MOOD LIFTERS SERVICES IS TO STOP USING THE SERVICES, EXCEPT IN LOCAL JURISDICTIONS WHERE SUCH LIMITATION IS EXPLICITLY UNENFORCEABLE.

Jurisdiction

Users agree that any dispute or claim related to use of the Mood Lifters App or Site is subject to the exclusive jurisdiction of the State and Federal courts in Michigan, U.S.A.
